Before equipment which is covered by the Electrical and Electronic Equipment Act goes on sale in Germany, it has to be registered with the EAR. There are several prerequisites for this:
- The equipment must be classified into a category and equipment type
- The weight of the equipment intended for circulation must be known
- The brand name and manufacturer’s name must be documented with photographic evidence
- An insolvency-proof guarantee must be provided, which is administrated by a trustee
- A waste disposal contractor must be named who can carry out the disposal should it be ordered

Please note:
- The registration process with the EAR can take up to 8 weeks even with the provision of all necessary documentation – further enquiries can delay this process.
- Non-registered affected products may not be sold in Germany. Misacting this law can lead to fines of up to € 50,000. An injunction, forbidding the sale of these products, can also result from non-registration.
